These Terms of Service ("Terms") govern your access to and use of ReadSprout's website, mobile applications, and services (collectively, the "Service") operated by ReadSprout Education LLC ("ReadSprout," "we," "us," or "our").
By accessing or using the Service, you confirm that you are at least 18 years old (or the parent or legal guardian of the child using the Service), that you have read and understood these Terms, and that you agree to be bound by them. If you do not agree, do not use the Service.
ReadSprout is an adaptive literacy platform that provides Science of Reading-based instruction for learners from PreK through Grade 12. The Service includes:
We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice of material changes.
A parent or legal guardian must create the family account. You agree to provide accurate information and to keep your login credentials confidential. You are responsible for all activity under your account. Notify us immediately at hello@readsprout.app if you suspect unauthorized access.
School and district accounts are created by authorized administrators. By creating a school account, you represent that you have the authority to bind your institution to these Terms and to our Data Processing Agreement.
Student accounts are created by parents (for family subscriptions) or by school administrators (for school accounts). Students do not create their own accounts. We use usernames rather than real names for student-facing accounts.
ReadSprout is a child-directed service. We comply fully with the Children's Online Privacy Protection Act (COPPA). Parents and guardians of children under 13 must review our Privacy Policy and COPPA Notice before using the Service.
We do not allow children under 13 to create accounts independently. We do not collect more information from children than is necessary to provide the Service. We do not use children's data for advertising or share it with third parties for commercial purposes.
Schools and districts that use ReadSprout must execute a Data Processing Agreement (DPA) with ReadSprout before deploying the Service to students. The DPA governs how student data is collected, used, protected, and deleted.
Schools are responsible for ensuring that the use of ReadSprout complies with FERPA and any applicable state student privacy laws. Schools act as the parent's agent under COPPA's school official exception and consent to data collection on behalf of parents for educational purposes only.
Schools may request a pilot period as described in their school agreement. Conversion from pilot to paid subscription is subject to the terms of the applicable school agreement.
Family subscriptions are billed monthly or annually as selected at checkout. Payment is processed securely by Stripe. We do not store credit card numbers. Subscriptions renew automatically unless cancelled before the renewal date.
New family accounts receive a 30-day free trial. No credit card is required to start the trial. At the end of the trial period, access will be limited unless a subscription is purchased.
Schools are billed per student per month as agreed in the school contract. Districts may be billed annually by purchase order. Payment terms are specified in the applicable agreement.
Family subscriptions cancelled within 7 days of the billing date are eligible for a full refund. After 7 days, the current billing period will not be refunded. School and district fees are non-refundable except as specified in the school agreement.
ReadSprout and all of its content — including curriculum, lesson activities, assessments, characters, artwork, software code, and the ReadSprout name and logo — are owned by ReadSprout Education LLC and protected by copyright, trademark, and other intellectual property laws.
You may not copy, reproduce, distribute, modify, create derivative works from, or commercially exploit any part of the Service without our express written permission.
Student work: Content created by students within the Service (written responses, recordings) belongs to the student and their family or school. We do not claim ownership of student-generated content.
You agree not to:
Violations may result in immediate termination of your account without refund.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. READSPROUT DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
ReadSprout is an educational supplement, not a replacement for classroom instruction or professional educational assessment. Results vary by student. We do not guarantee specific learning outcomes.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, READSPROUT'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO READSPROUT IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) $100.
READSPROUT WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR DAMAGE TO GOODWILL.
Some jurisdictions do not allow limitations on liability for personal injury or certain damages. In such jurisdictions, ReadSprout's liability is limited to the greatest extent permitted by applicable law.
You may cancel your account at any time through account settings or by emailing hello@readsprout.app. ReadSprout may suspend or terminate your account if you violate these Terms, if required by law, or if your payment method fails.
Upon termination, your right to use the Service ends immediately. For family accounts, we will delete your child's data within 30 days of account closure unless you request earlier deletion. For school accounts, data deletion is governed by the Data Processing Agreement.
